WRONGFUL
DEATH NYSRTL supports this bill, which would amend the estates, powers and trusts law in relation to wrongful death actions. The bill would safeguard the rights of the family of an unborn child fatally injured while in utero to institute a wrongful death action on behalf of the child. Currently thirty-eight states and the District of Columbia allow recovery for the wrongful death of a child who dies in the womb. It is an important and compelling state interest to safeguard the rights of such families to bring justice on behalf of their children.
